Terms of Service

1. Service description

Amber provides long-term memory storage and retrieval for AI assistants via the Model Context Protocol (MCP). The service allows AI assistants to store, search, and retrieve text-based memories on your behalf.

2. Account and eligibility

To use Amber, you must have a verified PayPal account. You must be at least 18 years old. One account per PayPal identity — creating multiple accounts to abuse free trials is prohibited.

3. Free trial

New users receive a 60-day free trial with full access to all features. After the trial period, your PayPal account will be automatically charged $1.99 USD per month. You may cancel at any time before the trial ends to avoid being charged.

4. Subscription and billing

Amber costs $1.99 USD per month, billed through PayPal. Your subscription renews automatically each month. You can cancel at any time through PayPal's subscription management. After cancellation, you retain access until the end of your current billing period.

5. Access and restrictions

When your subscription is active (including during the free trial), you have full access to all Amber features. When your subscription is inactive (cancelled, expired, or payment failed), all access is suspended — you cannot store, search, retrieve, or export memories until you resubscribe.

You retain full ownership of all content you store in Amber. We do not claim any rights to your memories. You can export all your data at any time using the export tool, and delete your account and all data using the delete account tool.

8. Service availability

We aim to provide reliable service but do not guarantee 100% uptime. The service is provided "as is" without warranties of any kind. We are not liable for data loss, service interruptions, or any damages arising from the use of the service.

9. Third-party services

Amber relies on third-party services (OpenAI, Google Gemini, PayPal, Cloudflare, Turso) to operate. Your use of Amber is also subject to these providers' terms of service. We are not responsible for outages or changes in these third-party services.

10. Data processing

When you store a memory, the text content is sent to Google's Gemini API (for chunking and expansion) and OpenAI's API (for generating search embeddings). By using the service, you consent to this processing. See our Privacy Policy for details.

11. Account deletion

You can permanently delete your account and all data at any time using the delete account tool. This action is irreversible. If your subscription has been cancelled or expired for more than 12 months, we may delete your data without notice.

12. Modifications

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. Material changes will be reflected on this page with an updated date.

13. Termination

We reserve the right to suspend or terminate accounts that violate these terms. In such cases, no refund will be provided for the current billing period.

14. Governing law

These terms are governed by the laws of the Netherlands.
